為貫徹落實中共中央辦公廳、國務院辦公廳印發的《保護司法人員依法履行法定職責規定》，最高人民法院日前發布了《人民法院落實〈保護司法人員依法履行法定職責的規定〉的實施辦法》（以下簡稱《辦法》），并同步發布司法人員履職保障十大典型案例。

The Supreme People's Court on Tuesday published a document on improving the mechanism to protect judges and their associates in fulfilling their legal duties. It stipulates that when handling cases, judges should not be subject to interference from other government organs, social organizations or individuals.

最高人民法院7日發文，落實保障司法人員依法履行職責的機制。文件強調，法官辦案時不受行政機關、社會團體和個人的干涉。

《辦法》共二十四條，涉及免受干預（free from interference）、免責機制（mechanism of accountability exemption）、救濟渠道（redress mechanism）、公正考核（impartial assessment）、安全保障（safety protection）、休假權利（vacation entitlement）、薪酬保障（salary guarantee）等內容，是對《保護司法人員依法履行法定職責規定》的細化和落實。

內容要點包括：

Judges have the right to refuse to follow any requests by any organization or individual that are without legal mandate or due process.

法官有權拒絕執行任何單位、個人違反法定職責或者法定程序、有礙司法公正的要求。

Judges are also entitled to refuse to comment on cases which are not in a judicial process or trials that they do not participate in.

法官有權拒絕就尚未進入訴訟程序的案件或者本人未參與審理的案件發表意見。

They are entitled to make complaints against nine types of action by governmental agencies or staff, including intervention in judicial process, obstruction of justice and restraint or suppression of the judges' independent expression of opinion.

法官有權對國家機關或工作人員的九種行為提出控告，包括：干預司法活動；妨礙司法公正；限制或者壓制法官獨立、充分表達對參與審理案件的意見；等等。

All courts should have committees to protect judges' safety, rights and interests.

所有法院都應設立保護法官安全和權益的委員會。

Judges and their associates should also be provided with recording devices at their workplace.

應該為法官和司法人員提供錄音錄像設備。

Those found guilty of interfering in judicial affairs, including threatening, insulting or harming judges, will face severe punishment.

威脅、辱罵或傷害法官等干預司法公正的行為將受到嚴懲。

Personal information of judges and their families should be protected.

法官及其家屬的個人信息應受到保護。
